My name is Ira Domnitz, and I am an Intellectual Property Attorney out of Houston, Texas. Do you have a cosplay or unique clothing design that you want to see if it can be copyrighted? Do you need your rights enforced, or protected?

Copyright laws are changing. Copyrights protect works of art in a tangible medium. This used to include music, literary works, dramatic works, dances, pictures, sculptures, movies, sound recordings, and architectural works.

Recently, the Supreme Court ruled that “the artistic feature of the design of a useful article is eligible for copyright protection if that feature (1) can be perceived as a two or three dimensional work of art separate from the useful article and (2) would qualify as a protectable pictorial, graphic, or sculptural work either on its own or in some other medium if imagined separately from the useful article.”
